Visa 188 is the first step in the plan to settle down (with 2 steps) in Australia under the guaranteed investment category, which is a program aimed at attracting investment capital from foreign investors to immigrate to Australia for economic development of the country. To participate in this business investment program, you need to be nominated by one of the Australian states.

For the Australian business and investor immigration program – Subclass 188, there are 3 basic options:

Business Innovation Stream – 188A – designated by the state government, requires Applicants to:

  • Under 55 years old
  • Possess at least AUD 800,000 in personal and business assets and be able to move to Australia within 2 years after the visa is granted.
  • Turnover in 02 years in 04 financial years of the business reaches at least 500,000 AUD
  • Own shares of at least:
    • 50% with sales less than AUD 400,000
    • 30% if turnover is over 400,000 AUD
    • 10% if the business is listed on the stock exchange
  • The applicant must achieve at least 65 points from the Australian Immigration Department (points are calculated when applying for the initial application).
  • No IELTS required if the Applicant can demonstrate completion of high school
  • The minimum required investment is AUD 800,000 in starting a new company or investing in an existing business and guarantees minimum ownership:
    • 50% with sales less than AUD 400,000
    • 30% if turnover is over 400,000 AUD
    • 10% if the business is listed on the stock exchange

With this option, the initial temporary resident visa is valid for 4 years and 3 months and can be extended for another 2 years. To convert to a 5-year permanent residence (Subclass 888), in addition to the requirements that need to be met on business, the applicant must ensure to have lived in Australia for at least 01 year in the 02 years before applying.

Investor Stream – 188B – Designated by the State Government, requires the Applicant to:

  • Under 55 years old
  • Have a combined personal and business net worth of at least AUD 2.25 million
  • At least 03 years of experience in managing legal investments
  • Having at least 01 year out of 05 years before submitting the application, the applicant satisfies at least 01 of 02 following conditions:
    • Own at least 10% of shares in the business
    • Possess legal investments worth at least AUD 1.5 million
  • The applicant must achieve at least 65 points from the Australian Immigration Department (points are calculated when applying for the initial application).
  • No IELTS required if the Applicant can demonstrate completion of high school
  • Minimum investment required is 1.5 million AUD invested in government bonds

With this investment stream, you can transition to permanent residency for 5 years (subclass 888) if you maintain your stay in Australia for at least 2 years out of 4 years, and maintain a designated investment with the Government. Significant Investor Stream – 188C – Nominated by the State Government or Austrade, requires the Applicant to:

  • Invest at least AUD 5 million in Australia, of which:
    • Company Invest a minimum of AUD 500,000 in Venture Capital and Private Equity Funds used to invest in start-ups or small private businesses
    • Invest at least AUD 1.5 million in an approved managed fund, invest in emerging businesses listed on the Australian Stock Exchange
    • A “balanced” investment of at least AUD 3 million that can be invested in a variety of ways (Australian stock exchange listed companies, bonds, Australian Government shares, commercial real estate, etc.) commercial)
  • No business experience, foreign languages, initial score registration (Point Test) and no age limit required.

With this investment option, the applicant can extend the visa for 2 more years (can be extended twice), and to convert to a permanent resident for 5 years, the applicant must ensure to stay in Australia for at least 2 years in the past year. 04 years before applying and must have maintained a nominated investment with the Australian State or Territory Government for at least 04 years.

In addition, to invest in Australia, there are 2 other investment streams including:

Premium Investor Stream – 188D – Appointed by Austrade, requires the Applicant to:

  • Invest at least AUD 15 million in one of the following options:
    • Shares listed on the Australian Stock Exchange
    • Australian Government Bonds or “semi-Government”
    • Bonds or warrants issued by a company listed on the Australian Stock Exchange (or its affiliate), an Australian state or Commonwealth Government, or a company with a rated bond/certificate is a portfolio in Australia
    • Individual limited liability companies in Australia
    • Australian real estate (excluding residential property)
    • Pension funds of insurance companies
    • Charitable contributions approved by Australian State and Territory Governments
  • No business experience, foreign language requirements, initial score registration (Point Test) with the Immigration Department and no age limit

To convert to permanent residency for 5 years from this investment option, you must have been in Australia for at least 2 years in the 4 years before you apply and must have maintained your nominated investment with the State Government or Australian territory for at least four years.

Entrepreneur – 188E – requires Applicant to:

  • Under 55 years of age (some Australian states or territories may not have this requirement if the Applicant’s proposed business would be of particular economic benefit to the designated state or territory there)
  • Provide proof of English language ability (minimum equivalent IELTS 6.0)
  • A business is an innovative idea that will lead to the creation of a new product/service in Australia, or to develop a business/business in Australia
  • Areas of activity may not include one of the following: Residential real estate business; Hire labor; Acquiring an existing business or Franchise in Australia
  • Applicants receive one or more investment commitments totaling a minimum of 200,000 AUD from one of the following organizations and agree to at least 10% of the funding amount to cover the day-to-day operations of the business for 12 months:
    • Australian Federal Government Agency
    • Australian state/territory government
    • Government Research Funding Organizations
    • Registered investment funds
  • Own at least 30% of newly established businesses
  • Have a specific business plan for an innovative idea to create a new product/service or grow a business in Australia.
